It is not always necessary for a treaty to be dated in order for it to be legally binding. Whether or not there is an expiry date of the treaty, there are three elements that must be present for a contract to be legally binding: offer, acceptance and consideration. In most States, a party may submit a written or oral offer, with the exception of exceptions, including real estate agreements or agreements exceeding a period of twelve months. After one party has made an offer and the other party accepts the offer, it is called acceptance. A contract should only be dated when all the parties who are required to perform the contract have done so. If a party has dated a contract prematurely, the date should be changed to a date that is not before the date on which the last signatory actually signed.
